Preamble: Language Exchange is an online support for English and Italian language learners to practice their language skills through written and spoken communication with other users. By accessing or using the Language Exchange online support, you agree to be bound by the following terms and conditions:

Article 1: Acceptable Use of the Online Support
1.1 The Language Exchange online support is intended solely for the purpose of learning and improving English and Italian language skills. Any use of the online support for other purposes, including but not limited to communication in languages other than English or Italian, is strictly prohibited in order to always ensure order and functionality of the community.

1.2 Users are encouraged to correct any grammatical or spelling errors made by other users in the course of their communication. To indicate a correction, users should use the "✅" symbol before and after the corrected sentence.

1.3 Users who are inactive on the online support for a period of 30 (thirty) consecutive days may receive a warning message from the administration reminding them to participate in the online support's activities. Failure to participate in the online support's activities after receiving a warning message may result in the user being removed from the online support.

Article 2: Prohibited Content and Conduct
2.1 Language Exchange is committed to providing a respectful and welcoming environment for all users. Accordingly, users are strictly prohibited from engaging in any conduct that is offensive, discriminatory, or otherwise disrespectful to other users.

2.2 Users are expressly prohibited from opening or participating in discussions on any of the following topics: politics, sexuality, illegal substances promotion, and shall, under no circumstance, including, but not limited to the language teaching purposes, refrain from sharing pornographic material with the community. Any user found to have engaged in discussions on these topics may be subject to disciplinary action, up to and including removal from the online support.
Ultimately, the member shall pay particular attention when engaging in topics that involve religious and superstitious beliefs.
POLITICS
To ensure compliance with the rule against discussing politics, it is crucial to acknowledge that such conversations can be contentious and emotionally charged, often rooted in deep-seated beliefs and values. Engaging in or initiating conversations that could be interpreted as political in nature, such as sharing news articles, expressing political views or engaging in political debates with other members, should be avoided.
While members may have strong opinions on certain political issues, it is essential to consider the impact sharing those views may have on the community, as it could lead to conflict and tension. Instead, members should seek constructive and respectful ways to express their opinions, such as writing a blog post or article that examines the issue without directly addressing politics.
ILLEGAL SUBSTANCES
To comply with the rule against discussing drugs exchange, members must refrain from engaging in conversations or sharing material that pertains to the distribution or consumption of illegal substances. This includes, but is not limited to, sharing links, pictures, videos, or any other content that promotes drug use or provides information on how to obtain or use illegal drugs.
Members should also avoid discussing their own experiences with illegal drugs or advocating for drug use in any form. Even discussing the legalization or decriminalization of drugs may be considered a violation of this rule, as it may be seen as promoting drug use.
It's important to note that any discussions related to drug use or distribution could potentially be harmful to other members and could even result in legal consequences. Members should be mindful of the potential consequences of their actions and ensure that their behavior is consistent with the terms and conditions of the community.
SEXUALITY
To comply with the rule against discussing sexuality, it is important to understand that Language Exchange has zero tolerance on this topic due to the possibility of underage members. As the minimum age requirement to join the community is 14 years old, it is crucial that members refrain from engaging in any discussions, sharing links, pictures, videos, or any other material that pertains to sexual topics. This includes but is not limited to, explicit sexual content, sexual innuendos, or discussions of sexual preferences and experiences.
It is imperative that members keep in mind that the community includes individuals of various ages, and some may be minors. Therefore, under no circumstances should any member engage in or initiate conversations, share materials, or promote content that is sexual in nature.
Language Exchange maintains a safe and welcoming environment for all members, and any violation of this rule will result in disciplinary action, up to and including removal from the community. By adhering to this rule, members can help create a positive and respectful atmosphere that fosters language learning and cultural exchange.
RELIGION
Religious discussions can be highly personal and sensitive, with individuals holding deeply-held beliefs and values that are tied to their faith. To avoid violating the rule against discussing religion, members should refrain from starting or participating in conversations that could be seen as religious in nature. This might include sharing religious texts, expressing beliefs or opinions about a particular faith, or engaging in debates with other members over religious topics.
If a member feels strongly about their faith or wishes to share their beliefs with others in the community, they should do so in a respectful and non-proselytizing manner. This means avoiding any language or behavior that could be seen as attempting to convert or persuade others to adopt their beliefs. Members should also be mindful of how their words may be perceived by others and should avoid making derogatory comments about other religions or individuals with different beliefs.

2.3 If a user witnesses another user engaging in conduct that is prohibited under these terms and conditions, or feels offended or bothered by another user's conduct, they should report it to the online support administrators immediately. Users are prohibited from taking any actions on their own to address such conduct, as this may cause additional disruptions to the online support's community.

2.4 In addition, members should be mindful of the language and tone they use when discussing other topics. They should avoid making personal attacks, using profanity or hate speech, or engaging in any other behavior that could be considered disrespectful or offensive to other members. By treating others with kindness and respect, members can help to create a positive and supportive community.

Article 3: Fees and Donations
3.1 The Language Exchange online support is free to use and accessible to all users.

3.2 Users who wish to support the continued development and operation of Language Exchange may make a donation to the online support. Information on how to make a donation will be provided to users separately.

3.3 Users understand that Language Exchange will not be able to refund any donations once received, all donations sent by the user are non-refundable.

Article 4: Modifications and Termination
4.1 Language Exchange reserves the right to modify these terms and conditions at any time, without notice to users.

4.2 Language Exchange reserves the right to terminate any user's access to the online support for any reason, at any time, without notice or liability.

Article 5: Governing Law and Jurisdiction
5.1 These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Language Exchange is headquartered.

5.2 Any disputes arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the jurisdiction in which Language Exchange is headquartered.

Article 6: Privacy
6.1 Language Exchange promises to protect the privacy of its users in accordance with applicable data protection laws.

6.2 Users' personal information will be used solely for the purpose of providing language exchange services and will not be shared with third parties without the user's consent.

6.3 Users' personal information collected, stored and used by Language Exchange are:
- First Name;
- Middle Name (if applicable);
- Last name;
- E-mail Address;
- Phone Number (if applicable);
- Telegram username (if applicable);
- Your native language;
- The country you come from;
- Your age (to determine if you are old enough to join the community or not);
- Your English level;
- Your Italian level;
- Any information you will decide to include in the section "Tell us a little more about you" in the Language Exchange Application form;

We are committed to protect and preserve these personal information that you provide us with and will solely be used for internal management and community related activities;

6.4 By using submitting the application to join Language Exchange, users agree to the collection and processing of their personal information as described in the privacy policy.

Article 7: Liability Disclaimer
7.1 Language Exchange is not responsible or liable for any problems or issues that may arise from the behavior of its members towards other members.

7.2 Users acknowledge that the platform is a place for language exchange and that they are solely responsible for their own interactions with other users.

7.3 Users agree to release Language Exchange, its affiliates, and their respective officers, directors, agents, and employees from any and all claims, demands, or damages arising out of or in any way related to such interactions.


Article 8: Use of WhatsApp & Telegram
8.1 Depending on the platform you will want to join Language Exchange on, you will probably need to download and use WhatsApp and/or Telegram to communicate with other members. Users must adhere to the terms and conditions of WhatsApp, and use the platform in accordance with its intended purpose, as created, developed, and released by Meta Platforms, Inc (for WhatsApp) and Telegram FZ LLC/Telegram Messenger Inc. (for Telegram).

8.2 Language Exchange is not responsible or liable for any issues that may arise from the use of WhatsApp and/or Telegram, including but not limited to privacy concerns or technical difficulties. Users are encouraged to review and familiarize themselves with WhatsApp's and/or Telegram's terms and conditions prior to using the platforms.

Article 9: Contact Information
9.1 By submitting an application to join Language Exchange, users automatically grant the platform permission to contact them using the contact information provided in their application.

9.2 This includes but is not limited to email addresses, phone numbers, and WhatsApp accounts.

9.3 Users acknowledge that Language Exchange may use this contact information to communicate with them regarding their application, their use of the platform, or any other relevant matters.

9.4 Language Exchange promises to use this contact information responsibly and in accordance with applicable data protection laws.

Article 10: Dispute Resolution
10.1 Any disputes arising from the use of the community shall be resolved through arbitration in accordance with the rules of Language Exchange.

10.2 The arbitration shall be conducted online in a separate virtual location than the usual Exchange group chat, and the language of the arbitration shall be English.

10.3 Users waive their right to participate in any class action lawsuits against Language Exchange.

Article 11: Use of Vulgar and Offensive Language
11.1 The use of vulgar language is not prohibited within the Language Exchange community, since we believe that every-day communication is inevitably influenced by those and it is part of the learning process to be immersed in it; however, members are encouraged to be mindful and limit the use of such language, especially when it can potentially cause emotional/psychological harm or offend the religions and beliefs of other members.

11.2 In accordance with moderation and respect policies, Language Exchange reserves the right to moderate any content deemed offensive or inappropriate and to take disciplinary measures, including expulsion from the community, against anyone who violates this provision.

11.3 Insults, threats, or discriminations against other members of the community are strictly prohibited, and all necessary measures will be taken to prevent and sanction such behavior. The violation of this provision may result in immediate removal from the service.
